Rental Assistance Program Agency Implementation Guidelines
The Rental Assistance Program has been funded by the CARES Act and is designed to assist Utah renters whose ability to pay rent has been negatively impacted by COVID-19, but whose needs are not being met by other programs. Two-Page Explanation of CARES Act Eviction Moratorium Posted by HUD’s Office of Multifamily Housing
HUD’s Office of Multifamily Housing Programs (Multifamily) posted a two-page explanation of the CARES Act eviction moratorium. It is designed for residents who have HUD-funded rental assistance and/or live in an FHA-insured property. “Addressing Tenant Concerns During the COVID-19 National Emergency” reminds residents who have rental assistance that they should continue paying rent if they can, but if their income has decreased they should contact property management right away and request an income recertification. If a resident does not have rental assistance but lives in an FHA-insured property, the resident is urged to contact their landlord right away and discuss a potential payment plan. The paper explains that evictions for nonpayment of rent are suspended until July 25, and even after that an owner can only file for eviction if the owner provides the household a notice of intent to file for eviction. However, that notice cannot be given until after the moratorium ends. |
Multifamily Properties Subject to Federal Eviction Moratoriums
The CARES Act provides a temporary moratorium on evictions for most residents of federally subsidized apartments, including those supported by HUD, USDA or Treasury (Low Income Housing Tax Credit developments) as well a moratorium on filings for evictions for renters in homes covered by federally-backed (FHA, Fannie Mae, and Freddie Mac) mortgages for 120 days after enactment.This searchable database and map allows some renters to identify if their home is covered by the CARES Act eviction moratoriums. These new tools contain data on millions of apartments in multifamily housing insured by the Federal Housing Administration or securitized by Fannie Mae or Freddie Mac, and millions more supported by the Low Income Housing Tax Credit, HUD, and/or USDA programs. The database and map are not comprehensive; they do not include data on single family rental homes of one to four units that are also protected under the CARES Act, and they do not include all Fannie Mae and Freddie Mac multifamily mortgages. Tenant and Landlord Communication is Key During the COVID-19 Pandemic
As advocates, we are advising renters struggling with making their monthly rent payments to be careful what they sign, and calling for landlords to exercise patience and compassion in working with tenants who may need to defer payments during the weeks ahead. We are grateful for the state’s efforts in allowing those who are facing layoffs or furloughs due to the coronavirus to defer rental payments for those impacted by the COVID-19 pandemic. This is a crucial step in allowing residents to focus on social distancing and remaining healthy. Although the moratorium has provided relief for many renters, the order is not specific in how landlords and tenants negotiate terms of deferment. We believe housing stability is crucial in a public health emergency in which containment and treatment rely on individuals staying indoors and not being forced to seek shelter or experience homelessness. Housing Instability and COVID-19 Map
The Senate last night ( 03/25/2020) voted unanimously to pass a $2 trillion direct spending bill to respond to the coronavirus pandemic, including more than $12 billion in funding for HUD programs. The bill now moves to the House, which will vote on it tomorrow. The president may sign the bill by as soon as tomorrow night. Stimulus Bill Provides Nonprofit Loans, Grants, and One-Year ‘Universal Deduction’

Utah Apartment Association creates rent deferment plan due to economic impact of coronavirus

Assistance such as deferred payments, loan modifications and fee abatements are available, and we are preparing to facilitate low and no interest federal disaster loans. Businesses and individuals facing economic challenges related to the spread of the COVID-19 virus should contact their bank as soon as possible. Banks have developed many programs designed to assist borrowers during periods of temporary economic stress. Read the full press release
